This Mentorship Service Policy (“Policy”) governs mentorship services provided through Call DAKM Mentors (“Platform”), including audio, video and chat mentorship and pay-per-minute and pay-per-session services, whether free or paid.
This Policy applies to all mentors and mentees/users using the Platform and shall be read together with the Platform’s Terms of Service, Privacy Policy, Payment & Payout Policy, Refund/Cancellation/Rescheduling Policy, Community Guidelines, Mentor Terms, Child/Minor Safety Policy and Grievance Redressal Policy.
In case of conflict between this Policy and a specific contractual or statutory requirement, the applicable law and relevant contractual provision shall prevail to the extent legally applicable.
The Platform provides technology and infrastructure to facilitate interactions between mentors and mentees.
Unless expressly stated otherwise, mentors are independent service providers and are responsible for the guidance, opinions, information and representations provided by them.
The Platform does not guarantee the accuracy, suitability, quality, availability, qualifications, conduct or outcome of any individual mentor.
The Platform may monitor, moderate, restrict, suspend, cancel or remove services, accounts, profiles or content where reasonably necessary for safety, legal compliance, fraud prevention, quality control, dispute resolution or protection of the Platform and its users.
Mentorship is intended for educational, professional, personal-development, career, philosophical, spiritual, IKS and other lawful guidance purposes.
Mentorship does not guarantee employment, admission, business success, financial gain, relationship improvement, spiritual advancement or any other particular outcome.
Mentors must not make guarantees, promises or representations of certain results that they cannot reasonably substantiate.
Users remain responsible for independently evaluating information received and for decisions taken based on mentorship.
Mentors must provide truthful, complete and up-to-date information regarding their identity, qualifications, experience, expertise, professional background, licences and other information requested by the Platform.
Mentors must not make false, misleading, exaggerated or unverifiable claims regarding their qualifications, achievements, affiliations, expertise or expected outcomes.
Mentors must promptly notify the Platform if any material information provided during onboarding becomes inaccurate or misleading.
The Platform may conduct reasonable verification and may request additional information or evidence. Verification by the Platform does not constitute a guarantee, certification, endorsement or continuing validation of a mentor.
The Platform may remove or restrict a mentor if information is found to be materially inaccurate, misleading, fraudulent or incomplete.
Mentors must provide services professionally, respectfully and within their stated area of expertise.
Mentors must not knowingly provide materially false or misleading information or facilitate unlawful activity.
Mentors must maintain appropriate professional boundaries and must not engage in harassment, discrimination, abuse, sexual misconduct, manipulation, coercion, threats or other inappropriate behaviour.
Mentors must not exploit a mentee's financial, emotional, personal, religious, spiritual or other vulnerability.
Mentors must not pressure a mentee to purchase additional sessions, products or services through misleading, coercive or manipulative conduct.
Mentors must disclose any material conflict of interest that could reasonably affect their mentorship or recommendations.
Mentors must not use a mentorship relationship primarily to promote their own unrelated business, products, investments, services, organisations or commercial interests without appropriate disclosure and Platform permission where required.
A mentor must not make recommendations solely for obtaining an undisclosed financial or personal benefit.
The Platform may restrict or prohibit relationships or transactions that present a material conflict of interest, safety concern or reputational risk.
The Platform may prohibit or restrict any mentorship involving unlawful activities, fraud, scams, financial exploitation, unauthorised professional services, sexual exploitation, grooming, child abuse, harassment, hate or discriminatory conduct, self-harm encouragement, criminal activity, impersonation, privacy violations, unauthorised solicitation or any other activity prohibited by applicable Indian law.
Mentors and mentees must not use the Platform for gambling, money laundering, fraudulent schemes, unauthorised fundraising, illegal transactions or other unlawful purposes.
The Platform may immediately restrict or terminate such activity where reasonably necessary to protect users, mentors, the Platform or comply with law.
Where minors are permitted to use the Platform, mentors must comply with all applicable child-safety, privacy and professional-boundary requirements.
Mentors must not engage in sexual, romantic, exploitative, manipulative, abusive or inappropriate communication with minors.
Mentors must not request unnecessary personal information, private photographs, intimate information or secret communications from minors.
The Platform may apply additional safeguards, restrictions, verification, monitoring or communication controls for minors or vulnerable users.
Suspected serious abuse, exploitation, grooming or child-safety violations may result in immediate account restriction and reporting to competent authorities where required or permitted by law.
Mentors are responsible for maintaining accurate availability, pricing, expertise and session information displayed on the Platform.
A mentor who accepts a booking is expected to make reasonable efforts to provide the booked service at the scheduled time.
Repeated cancellations, late attendance, abandonment of sessions or failure to provide booked services may result in warnings, adjustments, restrictions, suspension or removal from the Platform.
Where a mentor is unable to provide a scheduled session, the Platform may determine an appropriate resolution under its applicable cancellation, rescheduling and refund rules.
Mentees are responsible for providing accurate booking information, maintaining reasonable availability during scheduled sessions and ensuring that their device, internet connection and other required facilities are reasonably functional.
A mentee who fails to attend, disconnects without reasonable cause, provides materially incorrect information or otherwise prevents a properly scheduled session from being delivered may not automatically be entitled to a refund.
The Platform may consider session records and the circumstances of the matter before determining whether rescheduling, credit, refund or another resolution is appropriate.
Mentorship may be delivered through Platform-supported audio, video, chat or other communication facilities.
Users and mentors acknowledge that internet connectivity, device limitations, third-party infrastructure and other technical conditions may affect service quality or continuity.
The Platform does not guarantee uninterrupted or error-free service.
Where a demonstrable Platform-side technical failure materially affects a paid session, the Platform may provide reconnection, rescheduling, service credit, adjustment or refund in accordance with its applicable policies and law.
Technical problems exclusively attributable to a user's or mentor's device, internet connection or external service provider may not automatically create a refund entitlement.
For pay-per-minute services, charges shall be calculated using the applicable disclosed rate and billable duration recorded by the Platform.
For pay-per-session services, the applicable price, duration and material conditions shall be disclosed before purchase wherever reasonably practicable.
Minimum billing units, applicable taxes, platform fees, credits, deductions or other commercial conditions may apply as disclosed by the Platform.
Platform records may be relied upon for determining session duration and charges, subject to correction where a demonstrable technical error is established.
Bookings, cancellations, rescheduling and refunds shall be governed by the Platform's separate Refund/Cancellation/Rescheduling Policy.
The Platform may establish reasonable cancellation windows, notice periods and eligibility conditions.
Where appropriate and legally permissible, the Platform may resolve service issues through rescheduling, service credit, replacement service or another appropriate remedy instead of monetary refund.
No provision of this Policy is intended to exclude or restrict any mandatory statutory consumer right.
All payments, platform charges, mentor payouts, commissions, deductions, settlements, taxes and applicable payment conditions shall be governed by the Payment & Payout Policy and applicable law.
Mentors are responsible for their own applicable tax, registration, invoicing and professional obligations.
The Platform may deduct applicable taxes, withholding amounts, fees, adjustments or other lawful amounts before settlement where required.
Users and mentors must use authorised Platform payment channels and must not engage in payment manipulation, fraudulent transactions or chargeback abuse.
Mentors and users must not intentionally circumvent the Platform to avoid applicable Platform fees, controls, records or policies.
Mentors must not improperly redirect Platform users to personal payment accounts, competing platforms, personal websites or external channels for substantially similar paid services where prohibited by their contractual terms with the Platform.
Mentors must not use Platform access to solicit users for unauthorised products, services or commercial activities.
Sharing personal contact details or external communication channels does not automatically create a right to conduct Platform-related transactions outside the Platform.
The Platform may take appropriate contractual and legal action against suspected circumvention, fraud or misuse.
Mentorship relationships must remain professional and within the purpose for which the service was booked.
Neither mentors nor mentees should pressure, threaten, manipulate or emotionally exploit the other party.
A mentor must not demand gifts, personal financial assistance, loans, investments or other personal benefits from a mentee.
A mentee must not demand personal services, private access, guaranteed outcomes or preferential treatment outside the agreed mentorship service.
The Platform may intervene where a relationship creates a reasonable risk of exploitation, harassment, fraud, reputational harm or other policy violation.
Users and mentors must respect the privacy and confidentiality of information shared during mentorship.
Personal information must not be collected, disclosed, stored, published or used for unauthorised purposes.
Users and mentors should share only information reasonably necessary for the mentorship service.
The Platform's collection, processing, storage, disclosure and protection of personal data shall be governed by its Privacy Policy and applicable Indian data-protection requirements.
The Platform may retain and process relevant records where reasonably necessary for service delivery, security, fraud prevention, accounting, dispute resolution or legal compliance, subject to applicable law.
Where legally permitted and appropriately disclosed, the Platform may use technical monitoring, metadata, logs or other records for service delivery, security, quality control, fraud prevention, dispute resolution and compliance.
The Platform's system records, transaction records, timestamps, booking records, payment records and other technical information may be considered when investigating disputes, subject to applicable law.
Users and mentors must not secretly record, publish, distribute or commercially exploit another person's session, personal information or proprietary material in violation of applicable law or Platform policy.
Mentors retain ownership of their pre-existing intellectual property unless otherwise agreed, while granting the Platform the rights reasonably necessary to operate and promote the mentorship service.
Platform software, technology, branding, trademarks, systems and other proprietary materials remain the property of the Platform or its licensors.
Users may provide genuine ratings, reviews and feedback about mentorship services.
Reviews must not contain fabricated information, threats, extortion, harassment, unlawful personal information or attempts to manipulate ratings or refunds.
Mentors must not manipulate ratings, create fake reviews, threaten users for negative reviews or improperly influence ratings.
The Platform may moderate, restrict or remove content that violates law or Platform policies.
Complaints relating to mentorship services should be submitted through the Platform's designated grievance mechanism.
The Platform may request reasonable evidence, including transaction information, screenshots, session details, communications or other relevant information, to investigate complaints.
Users and mentors must reasonably cooperate with investigations and provide truthful information.
The Platform may consider available evidence, technical records, applicable policies and law while determining an appropriate resolution.
The Platform may reject claims that are unsupported, fraudulent, materially misleading or inconsistent with available records, subject to applicable law.
The Platform is not an emergency response, crisis intervention or emergency medical service.
Users experiencing an immediate threat to life, serious medical emergency, violence, abuse or other urgent danger should contact appropriate emergency services, qualified professionals or competent authorities.
Mentors must not represent the Platform as an emergency service or claim to provide emergency intervention unless appropriately authorised.
The Platform may restrict or terminate interactions involving serious safety risks.
The Platform may suspend, restrict, cancel or terminate access where it reasonably believes that a user or mentor has violated Platform policies, contractual obligations or applicable law, or where action is reasonably necessary for safety, fraud prevention, legal compliance or protection of the Platform and its users.
Immediate action may be taken in serious cases involving fraud, abuse, safety risks, unlawful activity, child protection concerns or evidence preservation.
The Platform may also take preventive action where continued access reasonably presents material legal, operational, financial, security or reputational risk.
Termination does not extinguish obligations or liabilities that arose before termination.
Financial settlements following suspension or termination shall be handled according to applicable contractual terms and law.
To the maximum extent permitted by applicable law, the Platform is not responsible for independent statements, advice, omissions, representations, conduct or decisions of mentors or users.
The Platform does not guarantee mentorship outcomes or uninterrupted availability of third-party infrastructure.
The Platform may use third-party providers for payments, communication, hosting, verification, analytics and other services and may not be responsible for failures exclusively attributable to such third parties beyond the Platform's reasonable control.
Nothing in this Policy excludes or limits liability that cannot legally be excluded or limited under Indian law.
All users and mentors must comply with applicable Indian laws, regulations, government directions and lawful orders.
The Platform may modify, restrict, suspend or discontinue any service where reasonably necessary to comply with legal or regulatory requirements.
The Platform may cooperate with courts, regulators, law-enforcement agencies, payment providers and other competent authorities where legally required or permitted.
Mentors remain responsible for obtaining and maintaining any professional licence, registration, approval or authorisation legally required for services they independently provide.
This Policy forms part of the Platform's overall contractual and operational framework.
Specific matters relating to privacy, payments, refunds, mentor obligations, community conduct, child safety and grievances shall additionally be governed by the respective Platform policies.
The Platform may update this Policy when required due to changes in law, regulation, technology, business practices, safety requirements or regulatory expectations.
By accessing, booking, providing or participating in mentorship through the Platform, users and mentors acknowledge that they have read and agreed to comply with this Policy and other applicable Platform policies.
If any provision is found invalid or unenforceable, the remaining provisions shall continue to apply to the extent permitted by law.
This Policy shall be governed by applicable laws of India. Subject to mandatory statutory rights and applicable dispute-resolution mechanisms, disputes shall be subject to the jurisdiction of competent authorities and courts as determined under applicable law.
The Platform reserves all rights and remedies available under applicable law and contractual arrangements.
