These Mentor Terms & Policy ("Policy") govern the registration, onboarding, listing and provision of mentorship services by every mentor ("Mentor", "you" or "your") on the Call DAKM Mentors platform ("Platform"), operated by CALL DAKM MENTORS PRIVATE LIMITED ("Company", "Call DAKM", "we", "us" or "our").
By registering, being approved, accepting a mentorship request, conducting a session, receiving payment or otherwise using the Platform as a Mentor, you agree to this Policy and all other applicable Platform policies, including the Terms of Service, Privacy Policy, Payment & Payout Policy, Refund/Cancellation Policy, Community Guidelines, Child Safety Policy and Grievance Redressal Policy.
The Mentor must provide complete, accurate, current and verifiable information requested by the Company, including identity, qualifications, experience, professional information, tax information and banking details.
The Mentor must not provide false, misleading, forged, borrowed or unverifiable information or misrepresent qualifications, certifications, registrations, experience, expertise or achievements.
The Company may conduct verification before or after onboarding and may request additional information whenever reasonably required for safety, compliance, payment, fraud prevention or Platform administration.
Approval as a Mentor does not constitute certification, endorsement, accreditation or guarantee by Call DAKM and does not guarantee continued access to the Platform.
The Mentor provides services independently through the Platform. Nothing in this Policy creates an employer-employee relationship, partnership, joint venture, agency, franchise, fiduciary relationship or similar relationship between the Mentor and the Company.
The Mentor has no authority to represent, bind or make commitments on behalf of Call DAKM.
The Mentor remains independently responsible for the statements, recommendations, conduct and services provided by the Mentor.
The Mentor shall provide mentorship only within the Mentor's genuine knowledge, competence, qualifications and experience.
Mentorship may involve career, education, professional development, personal development, life guidance, Indian Knowledge System, spiritual guidance or other approved categories.
Mentorship does not guarantee any particular academic, career, financial, personal, relationship, spiritual or other outcome.
A Mentor shall not represent ordinary mentorship as medical treatment, psychiatric treatment, legal advice, investment advice, financial advice, clinical counselling or another regulated professional service unless appropriately qualified, authorised and legally permitted to provide such service.
Where a matter falls outside the Mentor's competence, the Mentor should appropriately advise the mentee to seek qualified professional or emergency assistance.
Mentors must act honestly, respectfully, professionally and in good faith.
Mentors shall not engage in harassment, bullying, threats, intimidation, discrimination, hate speech, fraud, deception, coercion, exploitation, stalking, grooming, sexual solicitation, sexually inappropriate conduct or other unlawful or abusive behaviour.
Mentors must maintain appropriate professional boundaries with mentees.
A Mentor shall not exploit a mentee's age, vulnerability, emotional condition, financial circumstances, lack of knowledge or dependence on the Mentor.
The Company may take immediate protective action where reasonably necessary to protect a user, minor, Mentor, Platform or legal interest.
Where minors or vulnerable users are permitted on the Platform, Mentors must exercise heightened care and maintain strict professional boundaries.
Mentors must not groom, isolate, manipulate, exploit or encourage minors to move interactions to unauthorised private channels.
Mentors must not request unnecessary personal, intimate or sensitive information from minors.
Any serious safeguarding concern, suspected abuse, exploitation or other safety issue must be reported through the Company's designated reporting mechanism and, where required, to the appropriate authority under applicable law.
Information received from a mentee through the Platform must be treated confidentially and used only for legitimate mentorship purposes or as required or permitted by law.
Mentors must not sell, publish, disclose, misuse, commercially exploit or unnecessarily retain mentee information.
Mentors shall take reasonable security measures to protect personal information against unauthorised access, loss, disclosure or misuse.
Any suspected data breach, accidental disclosure or unauthorised access must be promptly reported to the Company.
Mentors must comply with the Platform Privacy Policy and applicable Indian privacy and data-protection requirements.
Platform audio, video, chat and other communication facilities must be used only for legitimate Platform purposes.
Communications may be recorded, stored, monitored or reviewed by the Company where permitted by applicable law and as described in the Privacy Policy, including for safety, quality, fraud prevention, dispute resolution, compliance and Platform administration.
Mentors must not independently record, publish, distribute or commercially exploit a mentee's communication or session except where legally permitted and appropriately authorised.
Mentors must have all necessary rights and permissions for content submitted to the Platform and must not infringe another person's intellectual-property, privacy, confidentiality or other rights.
Mentors must not deliberately divert or attempt to divert Platform users, bookings, relationships or transactions outside Call DAKM for the purpose of bypassing Platform fees, payment mechanisms, safety controls or other Platform processes.
Unless expressly authorised, Mentors must not encourage mentees to:
Mentors must not use Platform interactions to promote competing platforms or personal commercial channels for the purpose of circumventing Call DAKM.
Mentors must maintain accurate availability and make reasonable efforts to honour accepted bookings.
Repeated cancellations, unexplained absence, excessive delays, poor responsiveness or failure to conduct accepted sessions may result in restrictions.
Mentors must not artificially extend sessions, manipulate call duration, disconnect/reconnect improperly, create false bookings or otherwise manipulate Platform functionality to increase earnings.
The Mentor shall provide the service corresponding to the accepted booking and comply with Platform cancellation, rescheduling and refund procedures.
All Platform-originated payments must be processed through authorised Platform payment mechanisms unless expressly permitted otherwise.
Mentors must not demand unauthorised additional charges from mentees.
Mentor earnings, commissions, platform fees, deductions, refunds, adjustments, settlements, TDS and other payment matters are governed by the Payment & Payout Policy and applicable law.
The Company may make lawful deductions, withholdings, reversals or adjustments arising from refunds, chargebacks, fraud, payment errors, duplicate payments, disputed transactions, taxes or other legitimate Platform adjustments.
The Mentor must provide accurate PAN, bank, tax and other settlement information and is responsible for applicable taxes and statutory obligations relating to the Mentor's income.
The Company does not guarantee any minimum number of bookings, sessions, minutes, earnings, income, leads, ratings, profile views or Platform visibility.
The Mentor acknowledges that user demand, pricing, ranking, search results, recommendations, promotions, Platform algorithms and availability may change at any time.
The Mentor shall not treat past bookings, earnings or visibility as a promise of future performance.
Mentors must not manipulate or artificially influence ratings, reviews, bookings, cancellations, referrals, rankings, engagement or other Platform metrics.
Mentors must not purchase, fabricate or arrange false reviews or threaten, pressure or improperly incentivise mentees to provide favourable reviews.
Mentors must not create duplicate, fraudulent or misleading accounts to circumvent Platform restrictions.
The Company may investigate suspicious activity and take appropriate action.
Mentors are not required to tolerate abusive, threatening, unlawful, sexually inappropriate or otherwise unsafe conduct by a mentee.
A Mentor should promptly report serious misconduct through the Platform's reporting or grievance mechanism rather than attempting to resolve serious safety or legal matters privately.
The Company may review the complaint and may take action against the relevant user where appropriate.
Nothing in this Policy requires a Mentor to continue an interaction where doing so may reasonably create a serious safety or legal concern, subject to applicable cancellation and Platform procedures.
The Company may receive and investigate complaints relating to a Mentor, mentee, session, payment, communication, safety issue, privacy incident, fraud or other Platform activity.
The Company may review relevant Platform records and information reasonably available to it, subject to applicable law and its Privacy Policy.
The Mentor agrees to reasonably cooperate with legitimate investigations and provide relevant information or clarification when requested.
Mentors must not deliberately delete, alter, fabricate or conceal relevant evidence concerning a legitimate investigation.
The Company may take interim protective measures while an investigation is pending where reasonably necessary.
The Company may determine how, where and whether a Mentor profile is displayed, categorised, ranked, recommended, promoted or made available to users.
The Company may modify profile presentation, categories, search mechanisms, pricing structures, promotions, features or algorithms from time to time.
A Mentor does not acquire any permanent or guaranteed right to a particular ranking, category, profile position, number of leads or Platform feature.
The Company may remove, restrict or modify profile content that is inaccurate, inappropriate, outdated, legally problematic or inconsistent with Platform standards.
The Mentor retains ownership of intellectual property lawfully owned by the Mentor unless otherwise agreed.
The Mentor grants the Company a non-exclusive, worldwide, royalty-free licence, to the extent legally permitted, to host, store, reproduce, display, format and use submitted profile information, photographs, biographies, videos and approved promotional material for operating, improving and promoting the Platform.
The Mentor represents that submitted content does not infringe third-party rights.
Mentors must not misuse Call DAKM's name, logo, trademarks, technology, content or other intellectual property.
Mentors must not represent that Call DAKM endorses the Mentor's personal opinions, businesses, products, services or guarantees.
Mentors must disclose any material conflict of interest that may reasonably affect the quality, independence or integrity of mentorship.
Mentors must not use confidential information obtained through Call DAKM to unfairly compete with, exploit or harm the Company or its users.
Any personal products, services, businesses, courses, investments, memberships or commercial opportunities promoted during mentorship must be lawful, accurately represented and permitted under Platform policies.
The Platform may restrict commercial solicitation where it considers such activity inappropriate or harmful to users or the Platform.
To protect users, Mentors, the Platform and its legal, financial and reputational interests, Call DAKM may warn, restrict, suspend, temporarily disable, delist or terminate a Mentor account where it reasonably believes that the Mentor:
Where necessary, action may be taken immediately without waiting for completion of an investigation.
Where reasonably appropriate, the Company may provide the Mentor an opportunity to clarify or respond, subject to the seriousness of the matter, safety requirements, applicable law and operational considerations.
Termination does not remove obligations that by their nature survive termination.
The Mentor should first raise Platform-related disputes through the Company's designated grievance or support mechanism so that the matter can be reviewed and resolved efficiently.
The Mentor acknowledges that Platform records, booking records, payment records, system logs and other electronically maintained records may be relevant evidence in resolving Platform disputes, subject to applicable law.
To the maximum extent permitted by applicable law, the Mentor shall be responsible for losses, claims, penalties, liabilities, damages and reasonable legal costs arising from the Mentor's unlawful conduct, negligence, breach of this Policy, infringement of third-party rights, misuse of user information, unauthorised off-platform transactions or provision of regulated services without required qualification or authority.
Call DAKM operates as a technology-enabled mentorship platform and does not guarantee the conduct, qualifications, opinions, recommendations or results of every Mentor. The Company may undertake reasonable verification, moderation and safety measures but cannot guarantee that every violation, fraud or harmful interaction will be detected or prevented.
Nothing in this Policy excludes or limits any liability, statutory right or remedy that cannot legally be excluded or limited under applicable Indian law.
This Policy shall be governed by the laws of India.
Subject to applicable mandatory statutory rights, Platform disputes shall be handled according to the dispute-resolution and grievance provisions contained in the Company's Terms of Service and applicable Platform policies.
The Company may amend this Policy from time to time to reflect changes in law, regulations, technology, Platform features, business practices, safety requirements or compliance requirements. Material changes may be communicated through appropriate Platform mechanisms.
Continued use of the Platform after the effective date of an updated Policy constitutes acceptance of the revised Policy to the extent permitted by law.
By registering or continuing to operate as a Mentor, you confirm that:
